 Post subject: ARE WE ALLOWED TO PUT UP A CLOTHES LINE IN BAREFOOT BAY?

Hey everyone, I wondered if they ever came up with a rule here that says you cannot put up a clothesline? And if it is a new rule that says we can put one up, where would I find the location of the rule that says yay or nay? Thanks!

Our ancient 1969 DOR addresses clotheslines in ARTICLE II Section 9

However, I believe you will find that rule has been over ruled by Florida Statute, sorry, can't remember the number. That said, please be considerate of your neighbors and be sure to remove your husband from his necktie or britches before hanging them.

I have mine up now for quite awhile..love the smell of sun dried clothes and the lower electric bill..Have other things to spend that on..I do take them in as soon as they are dried as i don't think my neighbors need to see them in the back yard..no trouble yet.do own a dryer but we live in Florida.heat is heat..

Brenda,

I read your post and i agree with everything that you said, however everyone that would follow your example may have a different idea about that,and that is where the rub comes in.
Something like the picture inserted by intruder to you,could wind up being the result.
This is why they made that law..Just go to trailer parks that do not have a deed restricted
community and compare it to ours. This is why our community does not want this.
We are trying to keep Barefoot Bay beautiful! I doubt very much that this could happen if everybody in the bay put up clotheslines.

Hi Someone..I was raised as most folks here were..ALONG time ago.My mom and dad had alot of us kids to worry about but drying our clothes was not one of them..We had three lines that were kept pretty busy.Never owned a dryer..We are,in the state of Florida,allowed to have a clothes line..I would not be bothered about seeing laundry in the back yard..Even in Barefoot Bay..As I said,better things to spend it on..I think it is time to look backward at the things we take for granted.Lets see what we can do without,Might be surprised..I would NOT like to see the laundry in that great picture for sure..pretty funny..Have a great day..

Well, ya know, if everyone switched to wearing see thru clothes then the laundry lines wouldn't obstruct our vision. Although, we'd probably go blind around here.

20th century or not, anyone that wants one can have a clothesline in Barefoot Bay. It is the choice of the homeowner and NO ONE, not your neighbor or the DOR staff can force you to take it down. This is for the benefit of the environment and an individuals pocketbook and is allowed by both state and federal mandate. It may be convenient to dry your clothes in your home, but it actually costs you twice in power consumption since you have to cool the home that your dryer is actually heating at the same time. More power to those that embrace this pre-20th century technology!

Thanks Brenda for the tip on the towels. :idea:

I will try that on my next load of towels. We try to do most of our laundry on the line and it sure makes a difference in the electric bill.

Well folks, i hate to ruin your clothesline party, but this is what the deed of restriction says and has always said and if any of you clothesline people have ever read the deed of restrictions it explicitly says the following: UPDATED AUGUST 26TH 2008

SECTION 9. CLOTHESLINES

NO CLOTHESLINES OR DEVICES FOR HANGING OR DRYING OF CLOTHES SHALL BE PERMITTED ON THE EXTERIOR OF ANY HOME OR VACANT LOT.

If you do ,you are disobeying OUR law which is the deed of restrictions
here in Barefoot bay.

Gee someone, have you checked out the Right To Dry Law, it states that not even an HOA or DOR can do anything about putting up a clothesline. Sorry to burst your bubble, but if I wanted to put one up, I surely would in a heartbeat! And there isn't a thing anyone can do about it. It's funny how people have all the money in the world to give to FPL. I would rather spend it on other important things, such as hmmm, FOOD.

The confusion is actually over the fact that the State of Florida and Federal laws preempt our deed of restrictions.

Residents of the State of Florida would have to overturn the Florida State Statute listed below in order for our Deed of Restrictions to again have any impact on clotheslines. That probably will not happen anytime soon.

Florida Statute 163.04(2003) wrote:

FLORIDA STATUTES

TITLE 11. COUNTY ORGANIZATION AND INTERGOVERNMENTAL RELATIONS
CHAPTER 163. INTERGOVERNMENTAL PROGRAMS
PART I. MISCELLANEOUS PROGRAMS
Fla. Stat. § 163.04 (2003)

§ 163.04. Energy devices based on renewable resources

(1) Notwithstanding any provision of this chapter or other provision of general or special law, the adoption of an ordinance by a governing body, as those terms are defined in this chapter, which prohibits or has the effect of prohibiting the installation of solar collectors, clotheslines, or other energy devices based on renewable resources is expressly prohibited.

(2) No deed restrictions, covenants, or similar binding agreements running with the land shall prohibit or have the effect of prohibiting solar collectors, clotheslines, or other energy devices based on renewable resources from being installed on buildings erected on the lots or parcels covered by the deed restrictions, covenants, or binding agreements. A property owner may not be denied permission to install solar collectors or other energy devices based on renewable resources by any entity granted the power or right in any deed restriction, covenant, or similar binding agreement to approve, forbid, control, or direct alteration of property with respect to residential dwellings not exceeding three stories in height. For purposes of this subsection, such entity may determine the specific location where solar collectors may be installed on the roof within an orientation to the south or within 45 degrees east or west of due south provided that such determination does not impair the effective operation of the solar collectors.

(3) In any litigation arising under the provisions of this section, the prevailing party shall be entitled to costs and reasonable attorney’s fees.

(4) The legislative intent in enacting these provisions is to protect the public health, safety, and welfare by encouraging the development and use of renewable resources in order to conserve and protect the value of land, buildings, and resources by preventing the adoption of measures which will have the ultimate effect, however unintended, of driving the costs of owning and operating commercial or residential property beyond the capacity of private owners to maintain. This section shall not apply to patio railings in condominiums, cooperatives, or apartments.

DOR expired under MRTA in 1999. Anybody can do anything they want.

I know that about the DOR, how can I find info where they say it is amended or whatever says they can still bully people around here. If it is expired, who gives them the right? I sure would like to talk to you in person Mr. McCool. There are some things I would like to talk to you about that is going on with me here in Bully Bay. Thanks! Your reply would certainly be appreciated. Oh and hey Intruder, I want a windmill. And how can they update a DOR that is expired? Can anyone answer that for me?
